Delta Court Restrains IGP, Mrs Alli From Arresting PDP Exco

Delta State High Court has restrained the Inspector General of Police (IGP) from arresting the chairman and executive members of Peoples Democratic Party (PDP) in Oshimili South local government area based on spurious allegations made by a Delta North Senatorial aspirant and wife of former PDP national chairman, Dr (Mrs.) Marian Alli.

The court presided over by Justice K.O. Okpu, also issued an order allowing the applicants to enforce their fundamental human rights pending the determination of the suit.

The court order followed an application by the chairman, Evangelist Ebialim Maduemezie, and five others seeking for an order to restrain the IGP, Dr (Mrs) Alli and four others from arresting them based on mere allegation without first investigating same and coming to conclusion that there is a reasonable suspicion that the applicants committed criminal offences.

The applicants said their arrest and detention at separate period by the police based on allegations by the other respondents were wrongful, unconstitutional and contravened their fundamental human rights to personal liberty.

They asked the court to grant the sum of N5million as exemplary damages against the respondents jointly and severally their fragrant violation of their rights.

Other applicants in the suit are Elder Charles Nwarache, State PDP administrative secretary, Mr Monday Okoboshi, vice chairman PDP Oshmili South local government, Mrs Ngozi Nwabuonwu Woman Leader, Uche Onuorah, Youth Leader and Apostle Felix Okon Moses.

Other Respondents are Peace Ibekwe Abdallan, Commissioner of Police in charge of IGP Monitoring Unit, ASP Garba Masari, Miss Nkem Eboka, Financial Secretary, PDP Oshimili South l;ocal government area and Bridget Nmakwe.
